§ 9.6.147 STANDARDS.
   (A)   Design standards. PUDs must comply with the standards contained in §§ 9.6.95 through 9.6.113 , Design and Improvement Standards. However, the City Council may modify the design and improvement standards contained in §§ 9.6.101 Lots, 9.6.102 Blocks, 9.6.103 Streets and Roads, and 9.6.111 Park Land Dedication, upon request of the subdivider when the plan for a PUD includes provisions for efficient traffic circulation, adequate light, air and open space. In such cases, no application for a variance under § 9.6.191 , Variances, of these regulations is necessary.
   (B)   Streets. The arrangement, type, extent, width, grade and location of all streets must be considered in their relation to existing and planned streets, to topographical conditions, and to public convenience and safety.
   (C)   Open spaces. Each PUD must comply with the requirements of § 9.6.111 (D) of these regulations.
      (1)   The open space must be:
         (a)   Owned by a property owners’ association;
         (b)   Dedicated to public use, if acceptable to the governing body; or
         (c)   A combination of divisions (C)(1)(a) and (C)(1)(b) above.
      (2)   The governing body may waive dedication or cash donation requirements when the subdivider agrees to create a property owners’ association for the proposed subdivision and deed to the association land to be held in perpetuity for use as parks or playgrounds.
