(A) There is hereby established an Unsafe Building Fund (the Fund).
(B) The balance in the Fund, if any, remaining at the end of a fiscal year shall be carried over in the Fund for the following year and does not revert to the General Fund.
(C) In accordance with I.C. 36-7-9-14(b), money received in relation to the Town Unsafe Building Law as payment for or settlement of obligations or judgments, bonds posted, satisfaction of receivers’ notes or certificates, payment or settlement of civil penalties or fines, or collection of special assessments, shall be deposited in the Fund.
(D) Money expended from the Fund shall only be used for expenses incurred in carrying out the purposes of the Unsafe Building Law, in accordance with I.C. 36-7-9-14(c).
(E) The Enforcement Authority, as designated by § 155.15 of the Town Code, shall direct the expenditures from the Fund to fulfill the purposes of the Unsafe Building Law, in accordance with applicable law and appropriation requirements.
(F) An amount of $948 shall be transferred from the General Fund to the Unsafe Building Fund upon its creation.
