§ 51.13  ENVIRONMENTAL IMPACT FEE.
   (A)   From and after September 4, 1984, the owner of every tract of land, parcel, or lot, which is developed to be connected to the town’s water or sewer system, shall be charged an environmental impact fee (E.I.F.) per structure site developed.
      (1)   The fee, based on the town’s Residential Equivalency Unit (REU) schedule, shall be set, from time to time, by the Town Board of Commissioners. It is the intent of this section that the environmental impact fee shall be due at the time a water meter is set in place for the purpose of providing water service to the tract of land, parcel, or lot. If a water meter is already set in place, the environmental impact fee shall be due no later than the date a structure is first placed upon any structure site located on the tract, parcel, or lot.
      (2)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning:
         STRUCTURE.  By way of illustration and not by way of limitation, any dwelling cottage, dwelling house, apartment house, hotel, motel, house trailer, mobile home, commercial building, office building, rooming house, or any unit in a group housing development, planned unit development, townhouse, condominium development, motorized home, self-contained travel trailer, travel trailer, or other structure.
      (3)   Determination of fee.  The environmental impact fee is based upon the number of residential equivalent units in the structure.
         (a)   A residential equivalent unit is based upon uniform standards set by the town to approximate the gallons per day water/sewer use by a single-family residence and to use the figure as a common denominator to determine fees for other type structures.

   (4)   Appeal. Appeal may be made to the Town Board of Commissioners when the applicant deems the charge excessive. The Board of Commissioners shall have the authority to establish the impact fee upon the appeals.
