The City Manager is authorized and empowered to give a written notice to the owner, or agent of the owner, lessee or occupant of property abutting upon any street, lot, place or area within the following commercial areas of the City: 10th Street to 23rd Street, including, Water, Main, Market and Chapline Streets in the downtown and Centre Market areas; Zane Street from the Back Channel Bridge to the Fort Henry Bridge on Wheeling Island and the 2100 and 2200 blocks of National Road in the Elm Grove area, who fails or neglects to remove the snow and/or ice in accord with Section 543.01, then the City has the authority to remove the snow and/or ice and treat the sidewalk area and bill the owner for the City's service of removal and/or treatment. Such notice may be personally served upon the owner or agent of the owner, the lessee, or occupant of the property or in the alternative , or in addition to, may also be posted upon said property and sent to such owner or agent of the owner by regular and certified mail.
(a) Service Charge Included in a Bill. When the City has effected the removal of such snow and/or ice and the treatment of the sidewalk once such is removed, the actual cost thereof plus at a flat rate cost of $175.00 per man hour for the first hour or any part thereof and at a rate of $175.00 per man hour for any hour thereafter which may be prorated based upon the time expended. This cost shall be in addition to the accrued interest at the rate of six percent (6%) per year from the date of the completion of the work and if not paid by the owner, agent of the owner, lessee or occupant prior thereto, shall be charged to the owner of such property on a bill for the service charges forwarded to such owner by the City and the charge shall be due and payable by the owner at that time. Thereafter, if the bill for such service remains unpaid, the City is authorized to file a lien, in the manner provided by law, unless the delinquency is paid. (See generally W.V. Code §8-13-13). This provision is in lieu of any penalty provision included within this article.
