1111.10 ENCLOSURES FOR DUMPSTERS.
   (a)   Enclosures for dumpsters in public view shall be required effective January 1, 2005. Such enclosures shall be constructed of wood, metal or other suitable material and shall be constructed so as to:
      (1)   Obstruct the view of the dumpster generally from the public view and from other property owners.
      (2)   Not interfere with the removal of trash, garbage and debris from the dumpster nor with the cleaning of the area around the dumpster.
      (3)   The design and the materials to be used for such enclosure must be approved by the Building Inspector before construction. No fee will be required to be paid for the construction of such enclosure.

   (b)   It shall be the duty of any owner or tenant of property to clean the area around the dumpster as often as required to prevent and discourage animals and vermin from being drawn or attracted to that area. Any person or business violating this ordinance may be subject to a fine of up to five hundred dollars ($500.00) and court costs. Each day any such violation continues shall constitute a separate offense.
   (c)   Every property owner and their tenants who use dumpsters on their premises shall be jointly responsible and liable for all duties and penalties imposed by this statute.
