1111.08 JUNKYARDS.
   (a)   Screen Barrier Required. No person, shall own, operate or maintain any junkyard or any other business of like kind or character within the City without erecting a tight barrier of sufficient height screening such junkyard and the contents thereof from public view, which screen barrier shall not encroach upon the boundary line of any street, sidewalk or alley.
   (b)   Smoke and Odors not to Constitute a Nuisance. Junkyards shall be so maintained and operated that excessive smoke and offensive odors shall not be permitted to escape from such junkyards so as to constitute a nuisance to other properties in the neighborhood.
   (c)   Penalties.
      (1)   Any person owning, operating or maintaining a junk yard within the City in violation of the provisions of this article shall be deemed guilty of maintaining a public nuisance.
      (2)   Any person violating any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction thereof by the Mayor shall be punished by a fine of not less than five dollars ($5.00) nor more than one hundred dollars ($100.00).
      (3)   In addition to the aforesaid criminal remedy for the violation of any of the provisions of this article, the City or any citizen of the City may proceed against any person violating any of the provisions of this article by filing a suit in any court of competent jurisdiction for the purpose of abating a common or public nuisance and perpetually enjoining the same.
