909.02 GRADING/EXCAVATING PERMIT REQUIRED.
   No person shall do or cause to be done any grading, excavating, stripping or cutting upon any site within the City to include public streets, alleys, sidewalks or public grounds unless and until he has obtained a permit approved by the Mayor or his designee. Applicant must state the purpose of the excavation, and have obtained from the City a franchise to use the site as planned (see Article 926). Applicant must also provide plans, construction detail and timeline for the project. Applicant must bond work to an amount designated by the City to ensure full recovery of the work site(s). All relevant safety rules are incorporated into this section (FCC, Electric Code, etc.). Applicant also pays for City Engineering review, if ordered by the Mayor/designee. Provided, however, that no grading permit shall be required for the tilling or cultivation of any plot of ground within the City for the purpose of growing flowers, vegetables or other plants. Nor shall a grading permit be required for any other grading when the area of disturbed land surface is less than 150 square feet or when the net volume of cut and fill is less than five cubic yards.
