Notwithstanding anything herein to the contrary, for any violation of this article, where there exists a State Code section which has the same elements as the City Code section for which a penalty is imposed, the penalty imposed by the City may be up to that penalty imposed by the State. (a) In addition to the lien created by Section 905.09, any owner, lessee or occupant who violates any provision of Section 905.11 or fails to comply with any notice given thereunder, shall be fined twenty-five dollars ($25.00) for the first offense and fifty dollars ($50.00) for each subsequent offense.
(b) Each twenty-four hour period that such owner, lessee or occupant violates any provision of Section 905.11 or fails to comply with any notice issued thereunder, shall constitute a separate offense.
