(a) Notwithstanding anything herein to the contrary, for any violation of this article, where there exists a State Code section which has the same elements as the City Code section for which a penalty is imposed, the penalty imposed by the City may be up to that penalty imposed by the State. (b) No person licensed by the State of West Virginia under the provisions of Chapter 60, Article 7, of the Code of West Virginia, 1931, as amended, shall operate such private club within the corporate limits of the City without first obtaining a Municipal license permitting such operation from the City in accordance with the provisions of this article. Any person who operates such private club without having a Municipal license therefor issued by the City shall be guilty of a misdemeanor and upon conviction thereof shall be fined by the Mayor not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00).
