719.02 DEFINITIONS.
   (a)   “Adult book stores” means an establishment having as a substantial or significant portion of its stock in trade, books, magazines, films for sale or viewing on premises by use of motion picture devices or any other coin-operated means, and other periodicals which are distinguished or characterized by their emphasis on matter depicting, describing or relating to “specified sexual activities” or “specified anatomical areas”, or an establishment with a segment or section devoted to the sale or display of such material.
   (b)   “Adult motion picture theater” means an enclosed building with a capacity of fifty or more persons used regularly and routinely for presenting material having as a dominant theme material distinguished or characterized by an emphasis on matter depicting, describing or relating to “specified sexual activities” or “specified anatomical areas”, for observation by patrons therein.
   (c)   “Adult mini motion picture theater” means an enclosed building with a capacity of less than fifty persons used for presenting material distinguished or characterized by an emphasis on matter depicting, describing or relating to “specified sexual activities” or “specified anatomical areas”, for observation by patrons therein.
   (d)   “Adult entertainment cabaret” means a public or private establishment which is licensed to serve food and/or alcoholic beverages, which features topless dances, strippers, male or female impersonators, or similar entertainers, waiter or waitress.
   (e)   “Specified sexual activities” are defined as:
      (1)   Human genitals in a state of sexual stimulation or arousal;
      (2)   Acts of human masturbation, sexual intercourse or sodomy;
      (3)   Fondling or other erotic touching of human genitals, pubic region, buttock or female breast.
   (f)   “Specified anatomical areas” means:
      (1)   Less than completely and opaquely covered:
         A.   Human genitals, pubic region,
         B.   Buttock; and
         C.   Female breast below a point immediately above the top of the areola; and
      (2)   Human male genitals in a discernibly turgid state, even if completely and opaquely covered.
   (g)   “Adult use business” means:
      (1)   A business or enterprise that offers for a consideration physical contact in the form of wrestling or tumbling between persons of the opposite sex; and
      (2)   A business or enterprise that offers for a consideration activities between male and female persons and/or persons of the same sex when one or more person are nude or seminude; or
      (3)   A business which offers for a consideration nude human modeling.
   (h)   “Seminude” means a state of dress in which clothing covers no more than the genitals, pubic region, and areola of the female breast, as well as portions of the body covered by supporting straps or devices.
   (i)   “Distances” shall be measured in a straight line, without regard to intervening structures or objects, from the nearest portion of the building used as a business or enterprise described in subsections (a) through (d) and (h) above, to the nearest property line of the premises of a church or public or private elementary or secondary school, or the nearest boundary of a City or public park or playground.
