(a) Except as otherwise provided by law, no resident of the State of West Virginia who has reached his fifteenth birthday and who has not reached his sixty-fifth birthday, and no nonresident shall at any time take or fish for, take, kill or catch any fish, amphibians or aquatic life of any kind whatsoever in the City of Westover without first securing a license or permit from the State of West Virginia, and then only during open season, except that a nonresident of the State of West Virginia who has not reached his fifteenth birthday may fish for, take, kill or catch any fish, amphibians or aquatic life, of any kind whatsoever in the City of Westover without first having secured a license or permit from the State.
(b) Any person violating the provisions of this section shall be subject to a fine of up to one hundred dollars ($100.00) or sentenced to jail for a period of up to thirty days or both fined and imprisoned.
