1711.99 PENALTY.
   (a)    Whoever violates any provision of this Article 1711 Building Permits and Fees for which no other penalty is provided or fails to comply therewith or with any of the requirements thereof, or who erects, constructs, adds to or alters, moves or demolishes or has erected, constructed, added to or altered, moved or demolished a building or structure or portion thereof, in violation of a detailed statement or plan submitted and approved thereunder, or of a permit or certificate issued thereunder, and the owner of a building or structure, or portion thereof, or of the premises where anything in violation of this code shall be placed or shall exist, and an architect, engineer, builder, contractor, agent, person or corporation employed in connection therewith and who assisted in the commission of such violation shall be fined not more than five hundred dollars ($500.00). Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any provision of this Code is committed or continued.
   (b)    Any person who shall neglect or fail to secure any permit required under the provisions of this article, any person who shall cause or permit any other person to violate this article and any person who shall perform any work or labor in violation of the provisions of this article, or who shall cause, allow, permit or procure others to perform the same, in violation thereof, shall be deemed to be guilty of a violation of this article, each separate day the same shall constitute a separate offense and shall subject each such person to the penalties provided for herein.
   (c)    Any person who shall neglect or fail to secure any permit required under the provisions of this article shall have the permit double the normal amount, in addition to any fines and fees as stated above.
   (d)    The imposition of the penalties herein prescribed shall not preclude the City Attorney from instituting an appropriate action or proceeding to prevent an unlawful erection, construction, reconstruction, addition, alteration, conversion, removal, demolition, maintenance or use or to restrain, correct or abate a violation, or to prevent the occupancy of a building or structure or portion thereof, or of the premises, or to prevent an illegal act, conduct, business or use in or about any premises.
   (e)    All fines imposed by citations under this Article 1711 shall be due to the Municipal Court by the due date on the citation or a hearing date scheduled by the due date on the citation. Failure to pay when due any fine imposed or failure to schedule a hearing or show up for a scheduled hearing shall constitute a failure to appear or otherwise respond under WV Code 8-1-2b, will result in the issuance of a warrant and notification to the West Virginia Division of Motor Vehicles. Failure to pay when due any fine imposed under this section shall increase such a fine by one hundred dollars ($100.00). (Ord. 550. Passed 9-5-23.)
