149.01 INDEMNIFICATION OF CITY OFFICIALS.
   Where an elected or appointed Municipal officer of the City incurs a pecuniary loss as a result of such official being sued personally, for activities arising out of the discharge of his official duty, in a matter which the City has an interest in, and in the discharge of a duty imposed or authorized by law, and in good faith, the City through Council, shall have the discretionary power to appropriate reasonable funds to reimburse such official for any pecuniary losses so incurred as a result of such lawsuit, unless expressly forbidden to do so by the laws of the State of West Virginia or the laws of the United States of America, and in addition thereto, where appropriate, Council shall have the discretionary power to appropriate funds to reimburse such official for reasonable attorney fees so expended in such defense thereof.
