Pursuant to enabling Legislature §8-22-1 et seq. of the West Virginia Code, an ordinance is hereby adopted to read as follows:
(a) Definitions.
(1) “Fund” means the Police Retirement Fund.
(2) “Board” means Board of Trustees of the Fund.
(3) “Member” means an eligible employee of the City who is a member of the Fund.
(b) Board of Trustees.
(1) The City of Westover shall provide for a Board of Trustees of the Fund. The Board of Trustees shall consist of the Mayor and four members of the Fund, to be appointed by the Mayor, with the advice and consent of a majority of the members of the Fund. The initial appointments shall be for a term of one, two, three and four years, respectively; after which all appointments shall be for a term of four years.
(2) Said Board of Trustees shall be established, governed and maintained pursuant to §8-22-4 of the West Virginia Code.
(c) Employees Eligible for Participation in Fund.
(1) Employees eligible for the Fund shall include all policemen employed by the City of Westover on a permanent basis. All policemen employed by the City of Westover on July 1, 1991 are automatically qualified to participate in the Fund.
(2) All persons or employees who are not eligible for participation in the Fund are outlined in §8-22-5 of the West Virginia Code.
(d) Vesting. A member eligible for the Fund who has at least two years of continuous service with the City of Westover police force shall receive a vested right to receive a retirement pension. When the member has attained the age of fifty years he may, at his option, apply for a retirement pension, the amount to be determined in accordance with §8-22-7 of the West Virginia Code.
(e) Contribution to Retirement Fund. The City of Westover shall pay into the Fund a sum equal to seven percent of the members gross yearly salary. Contingent upon fund availability. A member shall be permitted to make contributions to the Fund and said contributions shall be determined by the Board of Trustees.
(f) Other Provisions. All other provisions of the establishment, maintenance, modification or enforcement of said Fund shall be governed by §8-22-1 et seq. of West Virginia Code and any amendments, modifications or deletions therein.
