(A) General provisions. In addition to the specific authority granted by this chapter, the Sanitary Board shall make and enforce such other rules and regulations subject to the approval of the City Council for the safe, economical, and efficient management, control, and protection of the city’s public sewage system, for the construction and use of house sewers and connections to the sewage system, for the construction and use of all other connections thereto, and for the regulations, collection, rebating, and refunding of such sewage service charges as may be needed or necessary from time to time; provided that such rules and regulations shall not become effective until the same have been approved by the City Council by ordinance or resolution and spread upon the records of the Council, as notice to the public of the provisions of said rules and regulations.
(B) Fee schedule. There is hereby established a fee schedule of just, reasonable, and equitable fees and charges for the use of equipment and services rendered by the city’s Sanitary Board in providing consumer service calls for utilization of the city’s Sanitary Board’s sanitary sewer service equipment and personnel for residential and commercial service calls to residences and businesses served by the city’s sanitary sewer collection and treatment systems, which fee and charges are to be paid by the owner of each and every lot or parcel of real estate, or building connected therewith, upon request and receipt of consumer service calls by the Sanitary Board personnel and use of the Sanitary Board’s sanitary sewage service equipment on the consumer’s private lines.
(1) Schedule of rates. The Sanitary Board shall charge the following fees for responding to consumer service calls as set forth above, in the following amounts, or other amount deemed appropriate by the Municipal Court:
(a) $50 an hour - regular working hour service call;
(b) $75 an hour - overtime service call;
(c) $200 an hour - up to four hours on weekend or holiday service call; and
(d) $25 an hour - flat charge for jet truck use.
(2) Invoices. Invoices for consumer service calls made by the city’s Sanitary Board shall be rendered monthly and shall be due and owing in the same fashion and following the same procedures as set forth in the current “Ordinance establishing a revised schedule of just and equitable rates and charges for the use of and services rendered by the municipal sewage system of the City of Weston, West Virginia, and providing for the collection of such rates and charges: amendment of applicable sections of Article IV, Chapter 23, the Code of the City of Weston as revised and enacted June 21, 2000”, with reference made hereto as if same were set forth herein verbatim.
(3) Exception to charge. There will be no fee assessed if it is determined that the consumer’s sanitary sewer problem is located within the city’s Sanitary Board’s maintained lines.
(4) One free service call. Each residence which utilizes the city’s sanitary sewer collection and treatment system shall get one service call without charge.
