126.24(A)
or
made nonconforming upon passage of this Chapter (originally on March 16, 1998), or on passage of any amendment thereto, shall be governed by the following regulations:
126.24(A)(1) A
existing within the
, or an area subsequently annexed to the
, upon the passage of this Chapter or any amendment hereof which, because of its

, location, or other characteristic, does not conform to this Chapter is hereby declared to be a nonconforming sign.
126.24(A)(2) A nonconforming
under § 126.11(C) (uniform
plan) must be removed at any time that 50% or more of the
in the multi-tenant project are replaced.
126.24(A)(3) A nonconforming
under § 126.10(B)(17) (channel letter signs) may be retained (provided that both the
and illumination are white), until the sign requires more than 50% of the
lettering to be replaced. Nonconforming
under § 126.10(B)(17) shall not be illuminated between the hours of 12:00 a.m. and 6:00 a.m.
126.24(A)(4) In a multi-tenant project with nonconforming
that are permitted to remain pursuant to the provisions of this Section, all new
shall conform to this Chapter.
126.24(B) The status afforded
under this Section shall not be applicable to any
for which no permit or
permit was ever issued; such
are deemed non-complying
and are subject to the provisions of this Chapter governing non-complying

126.24(C) If any nonconforming
is damaged by any cause and either:
126.24(C)(1) The cost of repairing the

then its classification as a nonconforming
under this Section shall be automatically revoked and repairs shall be made so that the

126.24(D) Loss of nonconforming status. A nonconforming
shall immediately lose its nonconforming status if the
is replaced, abandoned, altered or relocated, and the
shall be immediately brought into compliance with this Chapter (with a new permit secured) or shall be removed.
126.24(E) Nonconforming
maintenance and repair. Nothing in this Section shall relieve the owner or user of a nonconforming
, or the owner of the property on which the nonconforming
is located, from the provisions of this Chapter, regarding safety, maintenance and repair of
.
