1181.06 VARIANCES.
   (a)   The following regulations shall govern the granting of variances:
      (1)   The existence of exceptional topographic or other physical conditions.
      (2)   Strict application of these regulations would result in extraordinary and unnecessary hardship, or
      (3)   The purpose and intent of these regulations can be equally or better served.
   (b)   In granting variances or exceptions, the Planning Commission may require such conditions as it deems necessary to substantially satisfy the purpose and intent of these regulations. A variance or exception may be denied if the variance or exception is merely for the subdivider's convenience, such as when land is not useable or to correct an error or poor judgement of the subdivider, or in instances where the only justification is that compliance with these regulations would add to the development costs.
