141.04 SICK LEAVE/RETIREMENT/BEREAVEMENT LEAVE/PERSONAL LEAVE.
   (a)   Village of West Liberty Employees shall accrue sick leave credit at the rate of five (5) hours for each eighty (80) hours of service, or while in an active pay statute (i.e. during paid vacation and sick leave) to a maximum accrual of one hundred thirty (130) hours in any calendar year. Sick leave credit shall not accrue while an employee is on any unpaid leave of absence, on layoff, on disciplinary suspension or in any overtime status. Advanced use of sick leave shall not be granted.
   (b)   Sick Leave may be granted to an employee, upon approval by the Supervisor or Mayor for the following reasons:
      (1)   Illness, injury, or pregnancy-related condition of the employee.
      (2)   Exposure of an employee to a contagious disease which could be communicated to and jeopardize the health to other employees.
      (3)   Examination of the employee, including medical, psychological, dental, or optical examination, by an appropriate practitioner, when such examinations cannot reasonably be scheduled during an employee’s non- working hours.
      (4)   Death of a member of the employee’s immediate family. Such usage shall be limited to a reasonable necessary time, not to exceed three (3) days including the date of the funeral. Upon request of the employee, the Supervisor or Mayor may extend the use of sick leave as provided for in this paragraph for an additional period of time as approved by the Supervisor or Mayor.
      (5)   Illness, injury or pregnancy-related condition of a member of employee’s immediate family where the employee’s presence is reasonably required or necessary for the health and welfare of the employees or affected family member.
      (6)   Examination, including medical, psychological, dental or optical examination of member of the employee’s immediate family by an appropriate practitioner where the employee’s presence is reasonably necessary, and when such examinations cannot reasonably be scheduled during an employee’s non-working hours.
   (c)   For the purposes of the section, the definition of immediate family shall be: grandparents, brother, sister, brother-in-law, sister-in-law, daughter-in-law, son-in-law, father, father-in-law, mother, mother-in-law, spouse, child, grandchild, a legal guardian or other person who stands in place of a parent.
   (d)   In order for employee to be paid while on sick leave, he/she shall submit a “Leave of Request” Form and specifying the nature of the illness. All payment for any use of sick leave as provided for in this Article is subject to final review and approval by the Supervisor or Mayor.
   (e)   The Supervisor or Mayor may, when an employee utilizes sick leave for medical appointment for himself or for members of his immediate family, or when an absence is more than three (3) consecutive days, or when an employee has more than three (3) instances of sick leave use within any calendar year, require the employee to furnish a written statement from a licensed medical practitioner. Such statement shall include the nature of the illness or injury, the required treatment, and the prognosis. Failure to present such statement may result in the loss of sick leave pay or Disciplinary action. Disciplinary action may be taken for any falsification of sick leave statements or documentation, or for any dishonest action in obtaining sick leave pay.
   (f)   An employee who is unable to work shall notify his immediate supervisor or Mayor in a timely manner before his/her scheduled work time.
   (g)   If illness or disability continues past the time covered by accrued but unpaid sick leave, the employee, at his/her option, shall be granted use of earned vacation time and/or personal time. If the illness or disability continues past the expiration of all sick leave vacation and compensatory time the employee shall be granted a disability separation from which the employee will have one (1) reinstatement right.
   (h)   When sick leave is used, it shall be deducted from the employee’s credit on a basis of one (1) hour for every hour or part of an hour of absence from previously scheduled work. Compensation for sick leave used shall be equal to the employee’s current hourly rate of pay. Sick leave payment shall be made on the regularly schedule paydays.

   (i)   Bereavement leave will be granted by the Mayor.
   (j)   Each full time employee shall be entitled to three personal leave days, after one year of employment.
