951.03 MULTI-FAMILY DEVELOPMENT DUMPSTER REQUIREMENTS.
   (a)   All multi-family developments currently receiving rubbish collection services from the City or its contractor, without an approved dumpster location, shall install a dumpster location for the collection of rubbish by September 1, 2020 in order to continue receiving rubbish collection services by the City or its contractor. The dumpster location shall be installed in conformance with Section 1211.31(e), 1212.10(e) and all other requirements of the Zoning Code.
   (b)   The Association/Individual Property Owner shall make application with the Director of Planning for approval of the dumpster location.
      (1)   Applications which meet the minor revision provisions of Section 1220.09 shall be administratively approved by the Director of Planning pursuant to that section.
      (2)   Applications that do not meet the minor revision provisions of Section 1220.09 shall be referred to the Planning Commission with a revised development plan in accordance with Section 1220.01.
   (c)   Where it is determined by the Director of Public Service to be unfeasible or impractical to install a dumpster location, the Director of Public Service may approve the use of cart(s).
   (d)   The Association/Individual Property Owner shall grant the City of Westlake, its contractors and agents an easement for access at all times.
   (e)   The Association/Individual Property Owner shall execute a release, hold harmless and indemnification agreement in favor of the City of Westlake, its contractors and agents.
   (f)   “Multi-family development” for purposes of this chapter shall include a residential development comprised of condominiums, townhomes, cluster homes and/or apartments.
