§ 94.60 INVESTIGATION.
   (A)   The Town Clerk shall have the responsibility for enforcing the provisions of this chapter.
   (B)   The Town Clerk, upon receipt of a complaint from any person of the possible existence of any of the conditions described in § 94.46, or upon his or her own initiative, shall cause to be made investigations as may be necessary to determine whether conditions exist which may constitute a public nuisance as declared in § 94.46. The town shall have the authority to use a public or independent inspector to conduct this investigation, which shall be at the expense of the owner should violations be found.

   (C)   The owner or occupant shall, upon the request of the Town Manager and after proper identification, permit access to all parts of the site or structure as necessary, and at any reasonable time for the purposes or inspection, remediation and abatement of nuisance conditions, and shall exhibit and allow copying of all records necessary to ascertain compliance with this chapter.
   (D)   If the occupant or owner will not permit entry upon the property, the Town Clerk or Attorney shall complete the requirements of an administrative search warrant in order to inspect the conditions.
   (E)   It shall be the duty of the Town Clerk or Town Manager and the Town Clerk or Town Manager shall have authority to determine whether a public health or safety nuisance exists and if the owner or occupant shall be afforded the privileges and prescriptions set forth in this chapter.
