§ 35.99 PENALTY.

   (A)   Any person violating any provisions of this chapter, for which no specific penalty is prescribed, shall be subject to § 10.99.

   (B)   (1)   A first violation of §§ 35.20 through 35.23 is an infraction punishable by a fine not to exceed $50, but not by imprisonment.

      (2)   A subsequent violation of §§ 35.20 through 35.23 within two years is a Class C misdemeanor.

      (3)   Police officers shall have the discretion to issue a warning if they deem it is in the best interest of the city for the first offense.
