§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   A person violating § 90.03 may be fined up to $500 per occurrence.

   (C)   A person violating § 90.04 may be fined up to $500 per occurrence.

   (D)   A person violating § 90.05 may be fined up to $2,500 per occurrence. If the court find that a person has violated § 90.05 the court may, in its discretion, order other owned pets be seized by law enforcement with ownership relinquished to the Humane Society for Hamilton County, order the forfeiture of future pet ownership within the city, order counseling or order the animal owner to pay restitution. Notwithstanding any judgement under this section, animal cruelty, animal neglect or animal abandonment cases may also be prosecuted according to the I.C. 35-46-3-12.

   (E)   A person violating § 90.07 may be fined up to $500 per occurrence.

   (F)   Any person or caregiver determined to be in violation of § 90.08(D), (E) or (F) shall be issued a written warning and be allowed a period of time to come into compliance or provide satisfactory evidence of working to achieve compliance. Failure to comply shall result in a violation of this chapter. A person violating § 90.08 may be fined up to $500 per occurrence. Caregivers in violation of § 90.08 will lose caretaker privilege and will become subject to all sections of this chapter.

   (G)   A person violating § 90.09 may be fined up to $500 per occurrence.

   (I)   A person violating § 90.11 commits a Class C infraction and may be fined up to $500 per occurrence.

   (J)   A person whose animal is deemed a public nuisance animal violates § 90.12 and may be fined up to $1,500 per occurrence. Any such public nuisance animal may be impounded, and the owner or possessor charged for a violation of this chapter.

   (K)   A person violating § 90.13 may be fined up to $500 per occurrence.

   (L)   A person violating § 90.14 may be fined up to $2,500 per occurrence.

   (M)   A person violating § 90.15 may be fined up to $500 per occurrence.

   (O)   A person violating § 90.20 may be fined up to $500 per occurrence.

   (P)   A person violating § 90.21 may be fined up to $2,500 per occurrence.

   (Q)   Failure to register each litter shall be considered a violation of § 90.22 and shall be punished by a fine of not less than $100 or more than $2,500.

   (R)   Any person who is refused admission into a city building with an animal pursuant to § 90.23 and continues to enter the public building with the animal, may be fined up to $500 per occurrence.
