A. Street Cleaning; Snow Removal:
1. Street Cleaning: It shall be unlawful to park any vehicle on any street or roadway, or portion thereof, in the village at any time when such street or roadway is being cleaned. Whenever any police officer finds an unattended motor vehicle violating the terms of this subsection A1, the officer may provide for the removal of such vehicle to the nearest garage or place of safety by having the vehicle towed, at the owner's expense, in accordance with the provisions of chapter 9 of this title. Temporary signs indicating the date and time when such cleaning shall be performed and that violators shall be subject to towing at their expense shall be posted on the streets and roadways at least twenty four (24) hours before such cleaning work is performed.
2. Snow Removal: It shall be unlawful to park any motor vehicle on any street or roadway, or portion thereof, in the village for twelve (12) hours after a snowfall of two (2) or more inches, as determined by the official weather reading at Midway airport, has occurred, or until the snow has been removed, provided that the snowfall has stopped. Whenever any police officer finds an unattended vehicle violating the terms of this subsection A2, the officer may provide for the removal of such vehicle to the nearest garage or other place of safety by having the vehicle towed, at the owner's expense, in accordance with the provisions of chapter 9 of this title. The following signs shall be erected throughout the village at reasonable intervals to notify the public of the provisions of this subsection A2:
NO PARKING ON ANY STREET OR ROADWAY FOR 12 HOURS AFTER A 2 INCH SNOWFALL, OR UNTIL THE SNOW HAS BEEN REMOVED PROVIDED SNOWFALL HAS STOPPED.
MOTOR VEHICLES IN VIOLATION WILL BE TOWED AWAY AT THE OWNER'S EXPENSE.
3. Penalties: Any person convicted of violating any of the provisions of this section shall be assessed a fine not to exceed seven hundred fifty dollars ($750.00) and may be assessed such other fines, fees or costs, as are authorized by chapter 9 of this title or state law. Each day such violation is committed or permitted to continue shall constitute a separate violation and shall be punishable as such hereunder. The registered owner of a vehicle towed for a violation of this section may secure the release of the vehicle by furnishing evidence of his or her identity and ownership or possessory right to the vehicle, by signing a receipt for the vehicle and by paying or causing to be paid to the village and/or the towing and impoundment service operator the assessed fines and towing and impoundment fees.
B. Time Limit Parking: It shall be unlawful to park any vehicle for a period of time in excess of the amount of time designated by ordinance and so posted. (1978 Code § 9-5-3)
C. Vehicles For Sale; Peddling Merchandise From Vehicle: It shall be unlawful to park any vehicle upon any street for the purpose of displaying it for sale, or to park any vehicle upon any street from which vehicle merchandise is peddled or sold. (1978 Code § 9-5-6)
D. Loading Zone: It shall be unlawful for the driver of a vehicle to stand a passenger vehicle for a period of time longer than is necessary for the loading or unloading of passengers in any place designated by the village board as a loading zone and marked as such, or in any of the following designated places:
Directly in front of the entrance to any theater at any time that the theater is open. (1978 Code § 9-5-7)
E. All Night Parking: No person shall park any vehicle on any streets in the village between the hours of three o'clock (3:00) A.M. and six o'clock (6:00) A.M. of any day, except physicians on emergency calls, or persons granted permission by the department of law enforcement services. F. Alleys:
1. No person shall park a vehicle within an alley except for the purpose of loading and unloading merchandise and then only under such conditions as to leave available not less than ten feet (10') of the width of the roadway for the free movement of vehicular traffic.
2. No person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. (1978 Code § 9-5-9)
G. Cab And Bus Stands: No vehicle other than a licensed taxicab shall be parked in any area designated by ordinance as a cab stand, and no vehicle other than a bus shall be parked in a place so designated as a bus loading zone. (1978 Code § 9-5-10)
H. Parking Motor Vehicles On Private Property:
1. It shall be unlawful to park any motor vehicle on any private property without the consent of the owner of the property.
2. No truck having a gross weight of eight thousand one (8,001) pounds or more shall be parked on any driveway or open area of any lot in an R-1, R-2, R-3 or A residential district except for a period no longer than is necessary for the expeditious loading or unloading of such vehicle. 3. No truck having a gross weight of eight thousand one (8,001) pounds or more shall be parked on any street or public way in an R-1, R-2, R-3 or A residential district for more than four (4) consecutive hours, except in connection with its use for current work being done on adjoining premises and provided a permit therefor has been obtained for such extended parking in advance from the department of law enforcement services.
