6-2-14: DANGEROUS OR VICIOUS, BITING AND BARKING DOGS OR ANIMALS:
   A.   Dangerous Or Vicious Dogs Or Animals; Biting And Howling: No dangerous, or vicious dog or other animal, or dog which disturbs the peace and quiet of any persons as by howling or barking, shall be harbored or kept within the Village. Any such dog or animal, and any dog or animal which bites a person or another animal or so injures a person or other animal as to cause an abrasion of the skin, is hereby declared to be a nuisance and may be impounded. A dog or other animal is declared to be dangerous or vicious within the meaning of this section when a propensity to attack or to bite human beings or animals exists or as provided for under provisions of the Illinois Animal Control Act 1 . Where a dog or other animal injures a person or another animal or is otherwise determined to be a dangerous or vicious dog or animal by a Village or other governmental Code officer, animal control officer or law enforcement officer based on the documented conduct of the dog or animal, the Village shall file a report with the Cook County Department of Animal Control or such other governmental agency with regulatory authority for processing under the applicable provisions of the Illinois Animal Control Act 2 , or the Village may take such other action as is authorized and provided for by this chapter, other chapters of this Code or other applicable laws, including filing a nuisance abatement action as provided for under section 5-1-6, "Abatement Of Nuisance", of this Code.
   B.   Disposition: No owner of any animal, having knowledge that such dog or animal has bitten any person or another animal or so injured any person or animal as to cause an abrasion of the skin, shall sell or give away such animal, or allow such animal to be taken beyond the limits of the Village. Such owner shall place such animal in a recognized veterinary hospital acceptable to the Director of Law Enforcement Services and under the supervision of a registered veterinarian for a period required by law. The hospitalization shall be at the expense of the owner.
   C.   Seizure; Right Of Entry: Any police officer may enter upon the premises of any owner of a dangerous or vicious animal, or any animal suffering from rabies, or of one bitten by another animal suffering from rabies, and seize and impound said animal. Such entry may be made on the basis of the officer's personal knowledge of the facts, upon the filing with him of an affidavit by any resident of the Village that there is such an animal on said premises, or on the certificate of the Director of Law Enforcement Services that an animal suffering from rabies or one bitten by one suffering from rabies is on said premises. If such entry be made and the owner of said animal, or an immediate member of his family over sixteen (16) years of age, shall refuse to deliver such animal to such officer, and the officer cannot, with reasonable effort, catch the animal, he may kill it forthwith.    D.   Rabid Animals; Report; Disposal: Every veterinarian or other person discovering an animal suffering from rabies shall immediately report such fact to the Director of Law Enforcement Services. Such report shall give the name, if known, and the place of residence of the person owning, harboring or keeping such animal, the place where such animal can be found, and the license number of said animal, if known. Such animal shall be immediately taken up and placed in a recognized veterinary hospital where it shall be observed by a qualified veterinarian until it dies or is destroyed, after which the head shall be removed and a suitable pathological examination of the brain shall be carried out to determine whether or not the animal died of rabies.    E.   Barking Dogs: It shall be unlawful to allow a dog to disturb the peace and quiet of any persons by barking or howling. Barking or howling dogs must be quieted by the owner or taken inside. (Ord. 03-2245, 6-23-2003)
