6-1-2: WEAPONS:
   A.   Discharging Firearms And Air Guns: It shall be unlawful to discharge any firearm or air gun in the village; provided, however, that this subsection shall not be construed to prohibit any law enforcement officer from discharging a firearm or an air gun in the performance of his duty; nor to any citizen from discharging a firearm or air gun when lawfully defending his person or property. It shall not be a violation of this subsection for a law enforcement officer or other authorized person to discharge a firearm or an air gun on premises used by the department of law enforcement services as a target shooting range.
   B.   Discharge Of Other Weapons: It shall be unlawful to discharge or operate any toy firearm, bow, crossbow, slingshot or other device which discharges a bullet, arrow, pellet or other projectile; provided, however, that nothing in this subsection shall prohibit: 1) the use of such weapons at indoor shooting galleries or inside any private residence; and 2) the use of archery equipment as part of a department of recreation sponsored program.
   C.   Definitions:
AIR GUN: Any air gun, air pistol, spring gun, spring pistol, BB gun, paintball gun, pellet gun or any other implement or device that is not a firearm but which expels a pellet constructed of hard plastic, steel, lead or other hard materials or any other type of projectile or projectiles by the action of an explosion, expansion or escape of gas or other mechanical means with a force that may be reasonably expected to cause bodily harm.
FIREARM: As used in this section shall include the definition of "firearm" as contained in the "firearm owners identification card act" 1 , as amended, which is incorporated into this section by reference and shall also include any other device, by whatever name known, which is designed to expel a projectile or projectiles by the action of an explosion, expansion or escape of gas or other mechanical means.
The terms "firearm" and "air gun" and "weapon" are interchangeable.
   D.   Hunting: It shall be unlawful for any person to engage in killing or to hunt any bird or animal in the village using a firearm, air gun or other weapon.
   E.   Concealed Weapons: It shall be unlawful to carry any concealed weapons in the village without having first secured a license to carry such concealed weapons issued under the laws of the state.
   F.   Penalties; Confiscation: In addition to all other penalties provided for in this code or under state or federal law, any firearm, air gun or weapon used in violation of this section shall be forfeited to and confiscated by the village. (Ord. 04-2305, 6-28-2004)
