3-13-6: ENFORCEMENT; SUSPENSION OR REVOCATION OF LICENSE; FINES AND COSTS:
A.   Violations: The village manager or his/her designee, upon delivery of written notice or verbal notice, may suspend or revoke any license issued under the provisions of this chapter, if he determines that suspension or revocation is needed to protect the public safety or that the licensee has violated any of the provisions of this chapter or this code or the regulations contained in the "Administrative Procedures For Commercial Filming, Photography And Taping", as amended, or any other applicable state, county and federal laws and regulations. In lieu of suspension or revocation of a license or in addition to such penalties, the village manager, in his/her sole discretion, may levy a fine on the licensee. The fine imposed shall not exceed seven hundred fifty dollars ($750.00) for each violation. Each day on which a violation continues shall constitute a separate violation.
   B.   Hearing; Decision: If a license is suspended or revoked or a licensee is fined without a prior hearing, upon the written request of the licensee, the village manager shall conduct a hearing on the matter and provide the licensee with an opportunity to be heard within seventy two (72) hours after the request for hearing on the suspension, revocation or fine is received or such other date as mutually agreed upon by the parties. The village's notice shall advise the licensee of his or her opportunity to appear and defend against the charges contained in such notice. All notices shall be served via delivery by e-mail, certified mail or by personal service. Within forty eight (48) hours of conclusion of the hearing, the village manager shall issue a written decision relative to the revocation, suspension and/or fine that states the reasons for such determination and further states the amount of the fine, the period of suspension (if any) or that the license has been revoked or reinstated. A copy of the decision shall be promptly served upon the licensee.
   C.   Costs Of Hearing: Any licensee determined by the village manager to have violated any of the provisions of this chapter or the provisions of this code shall pay to the village the costs of the hearing before the village manager on such violation. The village manager shall determine the costs incurred by the village for said hearing, including, but not limited to: court reporter fees, the costs of the transcripts or records, attorney fees, the cost of preparing and mailing notices and orders, any and all additional fines imposed and all other miscellaneous expenses incurred by the village or such lesser sum as the village manager may allow.
   D.   Failure To Pay Fine; File For Injunction; Judicial Review: The provisions of subsections 3-9-11E, G and H of this title are incorporated herein by reference and are applicable to the regulations of this chapter. (Ord. 11-2646, 9-26-2011; amd. Ord. 22-3071, 3-21-2022)
