11-2-1: DEFINITIONS:
For the purpose of these regulations, the terms and words used herein shall be used, interpreted and defined as follows:
   ALLEY: Strip of land along the side of or in the rear of lots intended to provide secondary access to and from streets and such lots, and shall not be designed for general travel.
   BLOCK: A tract of land bounded by streets, or by a combination of streets and public parks, cemeteries, railroad rights of way, shorelines of waterways, or corporate boundary lines of the village.
   BOARD OF TRUSTEES: The president and board of trustees of the village.
   BUILDING SETBACK LINE: A line, generally parallel with and measured from the lot line, establishing the required distance between said lot line and the permitted structure or building area.
   EASEMENT: A grant by a property owner for the use of a strip of land by the general public, a corporation, or certain persons for a specific purpose.
   LOT: A portion or basic unit of a subdivision or other parcel of land fronting on a public street and intended to be that unit by which such land would be individually developed and transferred.
   OFFICIAL MAP: A map adopted by the board of trustees as provided by law showing the streets, highways, parks and drainage systems theretofore laid out, and any amendments and additions thereto resulting from annexation, approval and recording of new subdivision plats.
   OFFICIAL PLAN: The comprehensive plan adopted by the board of trustees, including all changes and amendments thereto duly adopted as provided by law.
   OWNER: The individual, firm, association, syndicate, copartnership, corporation or trust, or any other legal entity, having sufficient proprietary interest in the land sought to be subdivided for purposes of commencing and maintaining proceedings to subdivide such land as provided by law.
   PATHWAY: A strip of land dedicated or reserved for the purpose of providing pedestrian and bicycle access to neighboring areas.
   PLAN, CONCEPT: A general map or drawing on which the subdivider's schematic design for the subdivision of land is presented for discussion purposes prior to the expenditure of funds for preparing the preliminary plan.
   PLAN, PRELIMINARY: A detailed map, drawing or chart on which the subdivider's design for the subdivision of land is presented and which he submits in form for review and approval but not for recording.
   PLAT, FINAL: An accurate map, drawing or chart on which the subdivider's plan for the subdivision of land is presented and which he submits for final approval and intends to record in final form.
   PROTECTIVE COVENANT: Recorded conditions entered into between public and/or private parties and constituting a restriction on the use of all or some private property within a subdivision or development for the mutual benefit of successor property owners, and to provide protection against undesirable aspects of developments which would tend to impair the stability of values.
   ROADWAY PAVEMENT: The paved area existing on the street right of way, exclusive of sidewalks, driveway approaches or related uses, and its width measured from back of curb to back of curb.
   STREET: The street right of way or easement, whether public or private, and shall not be considered as the area of the paving or other improvement on the street right of way unless such paving and improvement coincides with the boundaries of such right of way.
   STREET, PRIVATE: A street located on private property for the purpose of providing vehicular access to that property.
   STREET, PUBLIC: A street located within a dedicated right of way for the purpose of providing vehicular access.
   STREET TYPES:
      Collector Or Secondary Street: A street which carries traffic from minor streets to the primary street system, including the principal entrance and circulation streets of residential areas and having direct access to abutting properties permitted (not permitted).
      Cul-De-Sac: A street having one open end and being permanently terminated by a vehicle turnaround at the other end.
      Marginal Access Or Frontage: A minor street which is parallel with and adjacent to primary streets and highways, and which provides access to abutting properties and protection from fast, through moving traffic on primary streets.
      Minor Or Local Street: A street with limited continuity and used primarily as access to abutting properties.
      Primary Or Major Street: A street of considerable continuity which serves or is intended to serve as a major traffic artery connecting large areas.
   STREET WIDTH: The shortest distance between the property lines abutting both sides of a street right of way.
   SUBDIVIDER: The owner, or any other person, firm or corporation authorized by the owner, undertaking proceedings under the provisions of this title for the purpose of subdividing land. The terms "applicant", "developer" and "subdivider" are interchangeable.
   SUBDIVISION: The division of land into two (2) or more parts, or any division of land which involves new streets or easements of access. The term includes resubdivision, and when appropriate, the context shall relate to the process of subdividing, or to the land subdivided. When two (2) adjoining buildable lots are combined to accommodate one or more buildings, structures, accessory uses and the facilities serving those structures and uses (i.e., driveways, etc.) such that the second buildable lot does not remain completely vacant, and/or if said lots are held in single fee ownership with a common permanent index number (PIN), then both lots will be deemed to be combined as one buildable lot requiring a variance from subdivision and development regulations before either may again be used as a separate buildable lot.
   VILLAGE: The village of West Dundee, Kane County, Illinois.
   VILLAGE ATTORNEY: The person or firm charged with the responsibility of providing legal counsel regarding municipal matters.
   VILLAGE ENGINEER: The person or firm charged with the responsibility of municipal engineering matters.
   VILLAGE MANAGER: The chief administrative officer of the village. (Ord. 89-04, 4-3-1989)
