7-5-1: DEFINITIONS:
   ABANDONED VEHICLE: Any vehicle in a state of disrepair rendering the vehicle incapable of being driven in its condition or any vehicle that has not been moved or used for seven (7) consecutive days or more if located on private property or for three (3) days or more if located on public property, and is apparently deserted contrary to the public policy expressed in section 5/4-301 of the Illinois vehicle code.
   COMMERCIAL VEHICLE: Any vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, for hire or not for hire, but not including a commuter van, a vehicle used for ridesharing arrangement when being used for that purpose, or a recreational vehicle not being used commercially. A limousine for purposes of this chapter is considered a commercial vehicle.
   DERELICT VEHICLE: Any inoperable, unregistered, discarded motor vehicle, regardless of title, having lost its character as a substantial property and left unattended without justification on the owner's land contrary to the public policy expressed in section 5/4-301 of the Illinois vehicle code.
   ESSENTIAL PART: Vehicle hulks, shells, chassis, frames, front end assemblies (which may consist of headlight, grill, fender and hood), front clip (front end assembly with cowl attached), rear clip (which may consist of quarter panels, fenders, floor and top), doors, hatchbacks, fenders, cabs, cab clips, cowls, hoods, trunk lids, deck lids, T-tops, sunroofs, moon roofs, astro roofs, seats, aluminum wheels, engines and similar parts.
   HAZARDOUS DILAPIDATED MOTOR VEHICLE: Any motor vehicle with any part, either damaged, removed, or altered or otherwise so treated that the vehicle is incapable of being driven under its own motor power or, which by its general state of deterioration, poses a threat to the public's health, safety and welfare. This shall include vehicles that have broken glass or sharp parts/objects attached. Vehicles that are inoperable on private property and still have a fuel tank shall be considered hazardous dilapidated motor vehicles.
   INOPERABLE MOTOR VEHICLE: Any motor vehicle from which, for a period of seven (7) days if located on private property and three (3) days on public property, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power.
   OWNER: A person other than a lien holder having a property interest in or title to a vehicle, boat, trailer, commercial vehicle or recreational vehicle. The term includes a person entitled to the use or possession of a boat, trailer, commercial vehicle or recreational vehicle, subject to an interest in another person, reserved or created by agreement and securing payment or performance of an obligation.
   PERSON: Any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust, estate or any other legal entity, or their representative, agent or assigns.
   RECREATIONAL VEHICLE: Any vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling for travel, recreational and vacation uses and/or vehicles with "RV" license plates. A recreational vehicle shall include, but not be limited to, travel trailer, pickup camper, motorized home and camping trailer.
   TRAILER: Every vehicle designed or utilized for the transportation of any boat, automobile, snowmobile and the like, which does not have motor power, but is designed to be drawn by another vehicle.
   VEHICLE: Every device, in, upon or by which any person or property is or may be transported or drawn, except devices moved by human power and devices used exclusively upon stationary rails or tracks. (Ord. 2006-45, 8-17-2006)
