5-3-2: PUBLIC DISPLAYS:
   A.   Permit Required: No public exhibition of fireworks or pyrotechnics shall be given unless a permit therefor is first secured from the village board thirty (30) days before the time of such display. All such public displays shall be under the supervision of a competent person, and shall be superintended by the chief of the fire department or some other member of the fire department assigned to this duty by him.
   B.   Bond And Insurance Requirement: No permit, as required in subsection A of this section, shall be issued unless the applicant therefor has filed with the village clerk a public liability bond or policy bond in the sum of one thousand dollars ($1,000.00) conditioned to pay any damage to property or injury to persons that may result or accrue from the storage, handling or display of such pyrotechnics. Additionally, no permit shall be issued unless the applicant therefor has filed with the village clerk a fireworks display application form and certificate of insurance naming the village as a primary, noncontributory additional insured with limits of not less than one million dollars ($1,000,000.00) per occurrence and excess coverage of not less than four million dollars ($4,000,000.00) covering general liability including bodily injury, personal injury and property damage and providing no shooter exclusion. Such certificate shall provide that the insurance shall not be terminated or renewed for any reason without thirty (30) days’ advance written notice to the village.
   C.   Smoking Prohibited: It is unlawful for any person in charge of such public displays to smoke any lighted pipe, cigarette or cigar at any time during which such public display is going on or in the vicinity of materials to be used for such displays.
