5-1-1: FIRE CODE ADOPTED:
A.   Adopted; Amendments: Pursuant to the authority granted by 65 Illinois Compiled Statutes 5/1-3-2, the village of West Dundee hereby adopts by reference, as criteria for the issuance of construction, reconstruction, alteration, repair and installation permits the provisions of the published 2021 International Fire Code with the following amendments:
   Section 101.1 These provisions shall be known as the fire prevention code of [Name Of Jurisdiction], hereinafter referred to as "this code".
      Insert: Village of West Dundee as the Name Of Jurisdiction
   Section 104.3 Add: The village shall have the authority to inspect all commercial buildings/businesses annually. An apartment building is classified as a commercial building. The village shall have the authority to inspect all non- sprinklered multi-family building apartments within the apartment building with six or more units annually, or any apartment as deemed necessary by the building or fire code official.

   Section 111: Means of Appeals shall be the village board with rules, regulations and procedures as described in section 111 of the adopted building code as amended in subsection 9-1A-1A of the municipal code.
   Section 112.3.3 Add: Violations may also be enforced through administrative adjudication as outlined in title 6 chapter 8 of the municipal code.
   Section 109.4 Insert misdemeanor for specific offense, insert $500.00 for dollars for amount, delete the following text "or by imprisonment not exceeding (number of days), or both such fine and imprisonment."
   Section 112.4 Insert $25.00 and $500.00 for amounts.
      Open burning shall comply with the International Fire Code and section 4-1-6- AIR POLLUTION CONTROL.
   Section 307.4.1: Bonfires. A bonfire shall not be conducted within 50 feet (15 230 mm) of a structure or combustible material unless the fire is contained in a barbeque pit. Conditions that could cause a fire to spread within 25 feet (7620 mm) of a structure shall be eliminated prior to ignition.
   Section 307.4.1: Add By permit when approved by the fire code official.
   Section 307.4.2 Recreational fires. Recreational fires shall not be conducted within 20 feet of a structure or combustible material. Conditions that could cause a fire to spread within 20 feet of a structure shall be eliminated.
         The fires fuel area cannot be more than three feet in diameter and must be two feet or less in height.
   307.4.3 Portable outdoor fireplaces. Portable outdoor fireplaces shall be used in accordance with manufactures instructions and shall not be operated within 15" (3048 mm) of a structure or combustible material.
      Delete exception: Portable outdoor fireplaces used at one and two family dwellings.
   307.4.4.2 Permanent outdoor fireplaces and fire pits fueled by natural gas shall be on non-combustible surfaces and ten feet from combustible material and follow manufactures requirements. A fuel shut off is required.
         The fires fuel area cannot be more than three feet in diameter and must be two feet or less in height or follow manufactures requirements and approved by the fire code official.
   Section 308.1.4 Open-flame cooking devices. Charcoal burners and other open flame cooking devices shall not be operated on combustible balconies or within 10" of combustible balconies.
      Exceptions: Delete Exception: 1. One and two-family dwellings.
         Delete Exception: 2. Where buildings, balconies and decks are protected by an automatic sprinkler system.
         Delete Exception: 3. LP gas cooking devices having LP-gas container with a water capacity not greater than 2.5 lbs LP-gas capacity.
            Air Pollution Control: Amend Section 4-1-6; Item C: Portable and fixed outdoor natural gas fireplace location is not less than 15" from any structures, including houses, sheds, decks, fences, vehicles or combustibles, located in the rear yard only and adequate provisions are made to prevent fire from spreading within 15" of any structures. A fixed noncombustible patio with a natural gas or propane gas grill can be within 10" of a structure.
               The fires fuel area cannot be more than three feet in diameter and must be two feet or less in height or follow manufactures requirements and approved by the fire code official.
   Section 903.2 Approved automatic sprinkler systems in new buildings and structures shall be provided
      Delete text: "in the locations described in sections 903.2.1 through 903.2.12"
   903.2 Add text: ", all use groups other than residential greater than 4,000 square feet in size and all groups A-5 @1000 square foot, R, H and I regardless of size". Those single family homes shall have an approved exterior horn/strobe Add and an interior horn strobe outside the master bedroom that activates on sprinkler water flow and a 10" bell connected to the HVAC duct work in the basement to notify the resident of sprinkler activation. A sprinkler head shall be added from the residential home at the doorway to the garage. Location to be approved by the fire code official.
   Section 903.3.8.5 Add: Fire sprinklers in a commercial building shall have a 10% psi safety factor between the demand and available pressures.
   Section 907.2 Where Required. An approved fire alarm system installed in accordance with the provisions of this code and NFPA 72 shall be provided in new buildings and structures in accordance with sections 907.2.1 through 907.2.23 and provide occupant notification in accordance with section 907.5, unless other requirements are provided by another section of this code.
      Delete text: in new buildings and structures in accordance with sections 907.2.1 through 907.2.23
      Insert text: in all locations which have fire suppression are required to have a fire alarm system, or any use group greater than 2,500 square feet.
   Section 907.2.A Buildings equipped with automatic fire suppression with flow switches placed on each floor level will not require smoke detection. The code official may require smoke detection in areas such as electrical rooms or rooms not easily identifiable to firefighting forces. Each building with a fire alarm shall have an approved exterior red strobe that activates on all alarms which will be located by the code official and an approved blue strobe placed 1" above the exterior sprinkler bell that activates on water flow only. Historical districts are exempt from the exterior horn/strobe requirements.
   Section 1013.1 Add: "Floor level exit signs are required in use group A2, night clubs".
   5001.1 (Hazardous Materials General Provisions) Add: "based on the zoning district and the fire code official approval."
   Section 5504.1 (Storage Cryogenic Fluids) Shall be limited to industrial zoned properties and requires issuance of special permit approved by the fire code official.
   Section 5604.1 (Explosive Material Storage And Handling) The storage of explosive materials is prohibited in the jurisdiction of the village of West Dundee without special permit approved by the fire code official.
   Section 5704.2.9 (Storage Flammable And Combustible Liquid Tanks) Add: "above ground storage of flammable and combustible liquids shall not be permitted without special permit approved by the fire code official".
   Section 6104.2 Liquefied petroleum gas shall be limited to any one installation not exceeding a water capacity of 500 gallons without special permit approved by the fire code official.
