3-5-2: MECHANICAL/ELECTRONIC AMUSEMENT DEVICES:
   A.   Mechanical/Electronic Amusement License And Alcoholic Liquor License: For establishments holding a valid liquor license in addition to a license for mechanical/electronic amusement devices, the following regulations shall apply:
      1.   No person under the age of twenty one (21) years shall frequent, loiter or play any "mechanical/electronic amusement device" as herein defined, without being accompanied by his or her natural parent or guardian, appointed by lawful order of court.
      2.   Each business establishment located within the corporate limits of the village where less than the whole of said establishment is dedicated to mechanical/electronic amusement devices, shall post a conspicuous sign stating that:
No person under the age of 21 years shall enter, frequent or play these devices without being accompanied by their natural parent or guardian appointed by natural lawful order of the court.

   B.   Mechanical/Electronic Amusement License And Alcoholic Liquor License And Video Gaming License: For establishments holding a valid liquor license in addition to a license for mechanical/electronic amusement devices and video gaming devices, as approved by the state of Illinois and the village of West Dundee, the following regulations shall apply:
      1.   No person under the age of twenty one (21) years shall frequent, loiter or play at any "mechanical/electronic amusement device" as licensed by the state of Illinois as a video gaming device.
      2.   Each business establishment located within the corporate limits of the village where less than the whole of said establishment is dedicated to mechanical/electronic amusement devices and/or video gaming, shall post a conspicuous sign stating that:
Video gaming terminal use by minors is prohibited. No person under the age of 21 years shall cause to remit, use or play a video gaming terminal.
      3.   It shall be unlawful for any persons to install, keep, maintain or use, or permit the installation, keeping, maintenance or use, upon its premises of any video gaming terminal, unless proper and valid licenses issued under this section for video gaming is issued and in effect.
      4.   It shall be unlawful for any person to operate as a video gaming terminal operator or video gaming terminal distributor within the corporate limits of West Dundee and distributing a video gaming device for use by any person or business for profit from the operation thereof, unless a license has been issued by the village and the license fee has been paid in full for the current year.
   C.   Mechanical/Electronic Amusement License Only: For all establishments holding a license for mechanical/electronic amusement devices and not holding a liquor license, the following regulations shall apply:
      1.   For all establishments where the entire establishment is dedicated to mechanical and electronic amusement devices and apparatus, and said mechanical/electronic amusement devices are the primary business of the establishment, and where a full time attendant is on duty and assigned specifically to the supervision, control and operation of said establishment, children under the age of sixteen (16) years shall be permitted to frequent, go upon and remain in said establishment upon the following terms and conditions:
         a.   An attendant or custodian is specifically designated for the purpose of supervising and controlling the activities in said establishment at all times such establishment is open.
         b.   That amusement machines are not considered gambling devices or similar to gambling devices under the laws of the state of Illinois.
         c.   That the business establishment post identifiable signs clearly visible within such establishment that the use of such amusement machines during normal school hours by school age children under the age of eighteen (18) years is specifically prohibited, and further adopt a procedure to identify customers under the age of eighteen (18) years, and prohibit said customers from use of said amusement machines during regular school hours during the school year.
         d.   That no such establishment shall be allowed operating hours earlier than eight o'clock (8:00) A.M. or later than ten o'clock (10:00) P.M. each day.
      2.   For all establishments where the primary business of the establishment is not mechanical/electronic amusement devices and where there are personnel present during business hours to regulate the other business, children under the age of sixteen (16) years shall be permitted to frequent, go upon and remain in said establishment upon the following terms and conditions:
         a.   That amusement machines are not considered gambling devices or similar to gambling devices under the laws of the state of Illinois.
         b.   That the business establishment post identifiable signs clearly visible within such establishment that the use of such amusement machines during normal school hours by school age children under the age of eighteen (18) years is specifically prohibited, and further adopt a procedure to identify customers under the age of eighteen (18) years, and prohibit said customers from use of said amusement machines during regular school hours during the school year.
   D.   Term, Nonassignability Of Mechanical/Electronic Amusement License: For all establishments described under this section, as a condition of issuance of a mechanical/electronic amusement device license hereunder, each licensee shall be provided with a written notification on the face of said license, stating that the licensee acknowledges that the license is issued for a one year term only, and is not subject to automatic renewal, assignment or transfer, and must be applied for on an annual basis.
