§ 53.12 WASTE DISPOSAL FEE.
   The City may charge the owner, or assess the property, or both, for the cost of collecting and disposing of waste from property located within the City. The current cost for refuse collection is as shown in the General Fee Schedule. Effective with the first quarter of 2016, the fee for refuse collection service shall be $51.09 per quarter.
   The fee is for the weekly collection and disposal of waste by the City from a waste container provided by the City, or a like quantity of waste in a container approved by the City. Each residence and business serviced by the City shall have its own waste container or containers. For purposes of this section, a residence is each unit in an apartment or housing complex and each part of a house or residential structure providing separate living quarters, including a bath, kitchen, and sleeping room, for an individual or group of individuals, related or otherwise. For purposes of this section, a business is each unit in a commercial building or strip center for an individual or group of individuals. The fee is also for the quarterly pickup of large items as set forth in Section 53.06, leaf collection, and also for the recyclables collection service.
   The City shall include the fee on the property owner’s utility bill, or as a separate bill, and the property owner shall pay the fee in the manner and amount specified on the bill. A property owner may, by agreement, require a tenant or lawful occupant of the property to pay to the City the fee; however, in the event of nonpayment, the property owner remains responsible for paying the fee.
