7-2-45: SIDEWALK REIMBURSEMENT PROGRAM:
The City will reimburse property owners for the replacement or rehabilitation of public sidewalks. The City will, as its cost of the improvement, reimburse property owners ten dollars ($10.00) per linear foot of the documented cost of the concrete for the eligible portion of the improvement. The City's fiscal year total funds available for this sidewalk reimbursement program will be determined by the City Council as stated in the City's annual appropriation ordinance. The following conditions govern the sidewalk reimbursement program.
   A.   The length of a reimbursable sidewalk replacement shall be at least one building lot in length or eighty (80) continuous linear feet. The grade, width, incline, and materials of sidewalks shall comply with the provisions of this chapter. Adequate barricades and traffic control shall be provided by the owner or contractor during construction of sidewalks.
   B.   Requests for sidewalk cost reimbursements will not be considered in connection with new building construction or to circumvent the requirements of the subdivision regulations set forth in title 4 of this code.
   C.   Funds will be available for reimbursement each fiscal year on a first-come, first-served basis. Property owners requesting reimbursement for sidewalk materials shall file a written application in the form provided by the City with the City Clerk. Applications will be reviewed by the Superintendent of Streets and Alleys; in the absence of the Superintendent, applications will be reviewed by the Chairman of the Streets and Alleys Committee.
   D.   Property owners must arrange for the installation of sidewalks through their own labor or contracted labor. Reimbursement will not be made unless the sidewalk is inspected and approved by a city inspector after it is formed and before it is poured, and inspected and approved again after final finishing.
   E.   To insure equitable distribution of sidewalk reimbursement funds, no more than fifty percent (50%) of each year's annual appropriation for sidewalk reimbursements shall be used in commercial and industrial zones. Any amount of the annual appropriation for sidewalk reimbursements may be used in residential zones.
   F.   Sidewalks on private property and driveway aprons are not eligible for reimbursement under this program. (Ord. 091619, 9-16-2019)
