No person shall construct or lay, or cause to be constructed or laid, any sidewalk where no grade has been established by ordinance, without having first obtained a grade therefor from the Mayor and City Council; nor shall he construct or cause to be constructed any sidewalk contrary to any grade which may have been or may hereafter be established by the Mayor and City Council.
