§ 151.16 PERMIT APPLICATION.
   (A)   Notwithstanding the provisions of § 151.15 of this chapter, any person within the limits of the town may make application with the town’s Public Works Authority for a permit to drill a water well; provided that, at the time the application is made, the premises upon which the well is to be drilled is not served by the public water system of the town.
   (B)   Any person making such application to drill, dig or otherwise put down a water well must furnish written evidence to the town’s Public Works Authority that the applicant’s premises are not served by the public water system at the time the application is made. In addition, the applicant, prior to commencing actual drilling, shall include in his or her application the location of the proposed well by street number, lot, block and addition. The application shall furnish an exact legal description of the premises upon which the well is to be drilled and also the name of the owner of the premises. The applicant must also describe any off-premises use of the water to be obtained through the well. Each application must be accompanied by a filing fee as set by the authority board.
