§ 94.06 PERMIT REQUIRED TO PLANT TREES OR SHRUBS IN PUBLIC WAYS.
   (A)   No person shall hereafter plant any tree or shrub upon any public way, street or alley unless he or she shall have first obtained a permit in writing from the Director of Public Safety and Service specifying the size, type, species and location on the public way, street or alley of the tree or shrub so to be planted. The cost of any such permit shall be $1.
   (B)   The Director of Public Safety and Service shall have the authority to deny a permit to any person who proposes to plant, upon a public way, street or alley, any tree or shrub of any size, type or species found to be undesirable by the Tree Commission or so found to be undesirable for the location proposed; or he or she may deny a permit to any person who proposes to plant any tree or shrub upon a public way, street or alley if at a location found by the Commission to be of a size or type unsuitable for planting trees or shrubs.
   (C)   The Director of Public Safety and Service is hereby empowered to notify any person who violates any provision hereof, that the person shall remove any tree or shrub planted without compliance herewith, said removal to be accomplished within 30 days from the date of notification. Failing the person’s compliance with the notification, the Director of Public Safety and Service shall cause the removal to be effected, with the cost of the same to be collected from the person who caused or authorized the violation.
