§ 34.02 TREE COMMISSION.
   (A)   Members. There is hereby created and established a Tree Commission (the Commission) for the city, which Commission shall consist of the following members: the Director of Public Service, one member of Council and up to seven community members appointed by the Mayor and approved by Council. Council’s selection of a member of that body for the Commission and approval of the persons appointed by the Mayor, shall be effected by motion passed by a majority of Council. The seven community members shall not be limited to residents of the city.
   (B)   Terms of office. The term of the Director of Public Safety and Service shall be for the time that any person holds that office. The term of the Mayor’s appointees shall be three years. The term of the Council member shall be for that person’s term as Council member. In the event that a vacancy shall occur during the term of any member, his or her successor shall be appointed for the unexpired portion of the term.
   (C)   Compensation. Members of the Commission shall serve without compensation.
   (D)   Powers and duties.
      (1)   Conduct of business. The Commission shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. All plans, findings, advices, reports and recommendations made by the Commission shall be in writing and designate by name those members of the Commission approving or concurring therein, and members who do not so approve or concur therein shall have the right, as part of such report, to state their reasons for refusing to approve or concur.
      (2)   General powers. The Commission shall have power to study, investigate, plan, advise, report and recommend to Council, the Director of Public Safety and Service or the Mayor any action, program, plan or legislation that the Commission shall find or determine to be necessary or advisable for the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs in public ways, streets and alleys.
      (3)   General duties. The Commission, when requested by Council, the Mayor, or Director of Public Safety and Service, shall consider, investigate, make findings, report and recommend upon any special matter or question coming within the scope of its work
