105.02  APPLICABILITY OF STATE LAW; EXCEPTIONS.
   Except where specifically provided for in this article, or where inconsistent with the terms hereof or with the Charter of the City, or with West Virginia Code Article 8-5 the provisions of West Virginia Code Chapter 3, Articles 1, 2, 3, 5, 6, 7, 8 and 9, where applicable, are hereby adopted and made part of the election law of the City, subject however to the following modifications:

   (a)   Ballot commissioners, as provided in West Virginia Code 3-1-19, shall be the City Clerk and two persons appointed by him.  Ballot commissioners shall be appointed at the times specified and shall perform the duties as described in West Virginia Code 3-1-19.  (3-8-83)
   (b)   Election officials shall be compensated by Council, but in no case shall exceed the compensation set forth in West Virginia Code 3-1-44. 
   (c)   All references in West Virginia Code 3-3-1 through 3-3-13, relating to absentee voting, to the Clerk of the Circuit Court shall, insofar as the City is concerned, be taken to mean the Clerk of the City and all applications and statements of physicians as provided therein shall be appropriately conformed to the requirements of the City.
   (d)   Ballots for the City elections shall be caused to be printed by the City Board of Ballot Commissioners at least forty-two days prior to the election and a sample of the ballot printed shall be published at least twice in a newspaper of general circulation in the City and shall also be posted at the front door of the City Building.
   (e)   The method of disposing of certificates of election as provided in West Virginia Code 3-5-15, prepared by the commissioners and poll clerks are inapplicable and in place thereof, only two certificates of election need be kept and the same shall be transmitted to the Mayor and to the City Clerk by the commissioners and poll clerks.
