(a) Marking; Filing Plat with City Clerk. Every person who owns or maintains a pole of more than ten feet in height which is placed upon the streets, alleys or public ways of the City shall, plainly mark each pole with a letter or an insignia adopted by them; and shall also file with the City Clerk a plat which shall show the location of each such pole, and upon such plat shall be indicated the letter or insignia by which such poles are marked. Upon the placing of any new poles a supplementary or amended plat shall be filed showing the location of the same.
(b) Annual Rental. All public utility companies shall pay to the City Collector and Treasurer as a rental or a charge in the nature of rental for the use and occupation of public sidewalks, public streets, public alleys and other public places by poles located thereon and owned by such companies, the sum of one dollar per year, for each and every pole located on such public sidewalks, public streets, public alleys and other public places, which sum shall be payable on the first day of November of each year so long as such companies shall use and occupy such public sidewalks, public streets, public alleys and other public places in the City.
(c) Effect of Failure to Pay Rental. Upon the failure of any such person to pay the amount charged against him, as certified by Council, as provided in the preceding section, before the first day of November of any year the same shall be an assessment and the amount thereof may be levied against any property owned by such person, and if the same cannot be then made the poles for which the same is charged may be removed.
