(a) No person without proper authority shall open or attempt to open by any method, a fire hydrant located within the municipal boundaries of the City of Wellsburg. For purposes of this provision, authorized persons are considered to be (1) employees of the Water or Sewage Department of the City while acting in the scope of their employment; (2) members of the Wellsburg Volunteer Fire Department or any fire department assisting the Wellsburg Volunteer Fire Department while responding to an emergency; (3) any person authorized by the City Manager.
(b) Any person violating this provision shall be fined the sum of two hundred fifty dollars ($250.00) for the first offense, and for the second offense shall be fined the sum of five hundred dollars ($500.00). In addition to such fine, any person violating this provision shall be liable to the City for the cost of any damage or repairs to any hydrant, water line, or any other property owned by the City.
