349.20  RAILROAD CROSSINGS; REPAIR, GRADE.
   (a)   Duty to Keep Crossings in Repair.  Any railroad company crossing with their road any street within this City, shall provide all proper crossings suitable for common and public use, and keep the same in proper condition at their own expense, so far as affected by the railroad company's use, and on failure fairly to comply with this section, Council may order repairs and alterations to be made at the company's expense; and such company shall be liable for any damage that may occur from such crossing being in bad condition.
   (b)   Changing Grade, Obstructing Traffic Prohibited.  No railroad company shall materially change the grade of, or use any street, not already appropriated, without the consent of Council previously obtained, for any purpose; nor shall such company stop any train within the City in such a way as to obstruct any cross street, nor shall they use any street for any purpose whatever, except for the legitimate, bona fide passage of trains, under such penalties and provisions as may be provided in Section303.99 .
