173.09  POLICE COURT JUDGE.
   (a)   Office Created; Powers.  There is hereby created the office of Police Court Judge of the City which judge shall have and exercise the powers enumerated in West Virginia Code Article 8-10.
   (b)   Appointment; Term of Office.  Council at the first meeting in July following every general City election shall appoint a qualified person to the office of Police Court Judge for a two year term.  Failing such appointment the incumbent judge will continue to serve until his successor is appointed and qualified.
   (c)   Removal Only for Cause.  The Police Court Judge shall not be subject to removal by Council during his term of office except for cause.
   (d)   Qualifications.  No person shall be appointed to the office of Police Court Judge who does not possess the following qualifications:
      (1)   An attorney at law duly licensed to practice by the Supreme Court of Appeals of West Virginia and admitted to practice before the Circuit Court of Brooke County, West Virginia.
      (2)   A resident of the City, except however, when no qualified applicant is available from the City then any person possessing the qualifications of (d)(1) above may be appointed.
   (e)   Salary to be Determined Annually.  The Police Court Judge shall receive an annual salary which shall be determined yearly by Council
   (f)   Judicial Powers of Mayor Retained.  The powers of the Police Court Judge appointed pursuant to this article shall be co-extensive with the judicial powers of the Mayor of the City and the Mayor shall be fully qualified to continue to exercise such judicial powers.
