155.02  POLITICAL ACTIVITIES BY EMPLOYEES.
   (a)   No employee or appointee in service to the City shall simultaneously, while in the employ of the City, be a candidate for, or hold any municipal office, in particular as a council person, mayor or member of the City Combined Water and Sanitary Board.  Nor shall any person directly or indirectly give, solicit or receive, or in any manner be concerned in giving, soliciting or receiving any assignment, subscription or contribution for any municipal candidate; nor shall any such person take an active part in any municipal political campaign.  Provided however, that during any vacancy in the position of the City Manager, the Council shall be permitted to appoint the Mayor as acting City Manager on a temporary basis during the period of the vacancy.  Council shall further have the authority to fix the salary of the Mayor while serving as the acting City Manager.
   (b)   Political activities of members of the Police and Fire Departments are restricted in accord with W.  Va.  Code §8-14-19 and W.  Va.  Code §8-15-24 respectively.
   (c)   Any violation of this section shall operate to forfeit the position held by the person violating the same and shall render any such person ineligible to any municipal office or position for a period of one year.
