(a) In accordance with Article IV of the Charter there is hereby created the position of Village Manager.
(b) The Village Manager shall be paid and receive the benefits in accordance with the Personnel Policy Manual as adopted by the Village of Wellington and as amended from time to time.
(1) The Manager shall manage, conduct, and control the water works, electric light plants, artificial or natural gas plants, or similar public utilities, furnish supplies of water, electricity or gas and collect all water, electric and gas rents.
(2) A. Subject to the approval by the Village Council, the Manager shall make such bylaws and regulations as he/she deems necessary for the safe, economical and efficient management and protection of such works, plants and public utilities when not contrary to municipal ordinances and resolutions or to the Constitution of the State of Ohio or laws of the State of Ohio. All such bylaws and regulations shall be maintained in written form together with the Village Manual of Policies and Procedures.
B. Once they have been approved by Council, all such bylaws and regulations shall be issued in written form, shall be filed with the Clerk of Council/Finance Director where they shall be available for public inspection, and shall be maintained together by the manager in a collection to be known as the Village Manual of Policies and Procedures where they shall be available for public inspection. In addition, they shall be made available for public access through the Village's website, or otherwise on the Internet; provided, however, that the delay or failure to make them so available, or any inability to access them on the Internet, shall not affect the enforceability of such bylaws or regulations.
(3) The Manager shall supervise the improvement and repair of streets, avenues, alleys, lands, lanes, squares, landings, market houses, bridges, viaducts, sidewalks, sewers, drains, ditches, culverts, streams and water courses, as well as the lighting, sprinkling, and cleaning of all streets, alleys, and public buildings and places.
(4) The Manager shall be responsible for the management and maintenance of public grounds and parks of the Village of Wellington.
(5) Subject to the approval of the Mayor and Council, the Manager may appoint officers, employees, agents, clerks and assistants, provided such positions and the wages therefore are first authorized by Village Council.
(6) The Manager is hereby designated as the purchasing agent for all Village offices, departments, divisions, boards and commissions and shall make all contracts, purchase supplies and materials and provide labor for any work in the Village in accordance with the provisions of Ohio Revised Code Section 731.141.
(7) Notwithstanding the provisions of Chapter 153, of the Ohio Revised Code, with respect to the award of any contract for the construction, reconstruction, improvement, enlargement, alteration, repair, painting, or decoration of a public improvement, the manager is authorized and fully empowered to specify in any contract bidding process that the award, and execution of the contract, may be made within such a time period after the date on which bids are opened as is deemed appropriate by the Village Manager and/or the manager may specify that the award and execution of a contract being funded, in whole or in part, by another governmental entity will be promptly awarded and executed upon confirmation acceptable to the manager that such funding has been approved; and, in either case, each bidder shall be required to honor and hold its bid open for acceptance as submitted subject to the specified condition(s).
(8) The Manager shall serve under the supervision and control of the Mayor and shall have such other powers and duties as are prescribed by ordinance or by law and which are not inconsistent herewith.
