777.07 CONDITIONS OF PERMIT.
   All mobile food establishment permit holders shall be subject to the following:
   (a)   Each permit issued shall be valid for either the three-day period for which applied/approved (for single event permits) or from the approval date through December 31 of the year in which it is issued.
   (b)   The permit issued shall be valid only for the permittee and is not transferable in any manner.
   (c)   The permit may be temporarily suspended by the Manager if the right-of-way is being used and the public interest requires use of the right-of-way for a public event, construction, repair, or any other public purpose. In the event of such a suspension, the Manager shall have the discretion to grant a proportional extension of the permit time or a proportional refund of the permit fee, as appropriate.
   (d)   The permit is specifically limited to the area approved (or as modified by the Manager), and will include a diagram indicating the area approved for the sidewalk cafe and the location of any tables, materials, merchandise, sign, or equipment permitted to be in the right-of-way.    
   (e)   The sidewalk and all things placed there shall at all times be maintained in a clean and orderly condition. The mobile food establishment shall provide and maintain a container suitable for the placement of litter, which litter shall be removed by the vendor at the close of the business day and properly disposed of by the vendor.
   (f)   No food cart or related equipment of the operation shall remain within the sidewalk or right-of-way at any time that the mobile food establishment is not in operation.
   (g)   Each mobile food establishment shall be continuously supervised by employees of the establishment.
   (h)   Each mobile food establishment shall continuously meet all applicable requirements of the Lorain County Health Department.
   (i)   A mobile food establishment shall operate only within the hours for which it has been approved.
   (j)   Each mobile food establishment shall maintain a legible copy of its approved permit on-site during all hours of operation; and the same shall be disclosed to any law enforcement officer upon request.
   (k)   The Village has the right to repeal or amend this chapter and thereby terminate or modify all sidewalk cafe operations. No permittee shall obtain any property right in the continued private commercial use of the public sidewalk.
   (l)   Businesses shall not serve or permit the consumption of alcoholic beverages within the public sidewalk or right of way under any circumstances.
