4.01 Manager.
   (A)   The Mayor shall appoint a Manager who shall take office upon confirmation by the Council by a majority vote of its members. The Manager shall serve at the pleasure of the Mayor and the Council and may be suspended or removed from office by the Mayor with the consent of the Council granted by a majority vote of its members, or by the Council by a three-fourths vote without the consent of the Mayor.
   (B)    The Mayor and the Council shall deal with the officers and employees who are subordinate to the Manager only through the Manager; except that the Mayor or the Council may require the Manager or his/her subordinate officers or employees to meet to provide information, answer questions or provide oral or other evidence (sworn or unsworn) before the Council or any committee appointed by the Council. The Mayor and Council may deal directly with the Chief of Police and with all other officers and employees of the Village not subordinate to the Manager.
   (C)    The Mayor, with the approval of a majority of Council, may appoint an Acting Manager if there is a vacancy, absence, or disability of the Manager, which Acting Manager shall serve at the pleasure of the Mayor and Council. The Acting Manager shall have the powers, duties and functions of the Manager.
   (D)    The Mayor, in consultation with the Council, shall assure that a Job Description is maintained for the position of Manager. The Manager shall be appointed on the basis of the candidate’s education and/or administrative and executive skill and experience in the arena of public management; or based upon the candidate’s knowledge of the operations of municipal government. The Mayor and Council shall be the sole judge of the qualifications of the Manager.
   (E)   The Manager shall not hold any other public office or position with the Village, except that the Manager may serve in any position as an authorized or designated representative of this Municipality on any board, commission, or other governmental entity, or to further intergovernmental cooperation and except that the Manager is not prevented from serving in the State Militia or Reserve Corps of the United States, or as a Notary Public, or as an official of a political party, and may hold any office permitted by the Charter or the laws of Ohio.
