767.01 GARBAGE AND RUBBISH DISPOSAL.
   (a)   Every operator of a business within the Village shall dispose of all of the rubbish generated by the business in a clean and sanitary manner by placing it in approved receptacles or in other approved rubbish disposal facilities.
   (b)   Every operator of a business within the Village shall disposal of all garbage generated by the business and any other organic waste which might provide food for insects and rodents in a clean and sanitary manner by placing it in approved, nonleakable, nonabsorbent, covered garbage storage receptacles or in other approved garbage disposal facilities.
   (c)   It shall be the duty of every operator of a business within the Village to provide, or cause to be provided, and at all times thereafter to keep or cause to be kept and provided for the exclusive use of such business, receptacles with close-fitting covers for receiving and holding without leakage, all garbage and rubbish, so long as such garbage and rubbish remains upon or in such building, premises or places of business.
      (1)   Such receptacles shall be regularly located and maintained upon private property only.
      (2)   Where necessary, such receptacles may be permitted to be temporarily placed upon a public sidewalk and/or within the public right-of-way, in a manner which does not obstruct pedestrian or vehicle traffic, in anticipation of pick-up for permanent disposal of the refuse. Placement/storage of such receptacles upon a public sidewalk and/or within the public right-of-way shall only be between sunset of the day prior to expected pick-up and sunset of the day of pick-up; placement/storage of such receptacles upon a public sidewalk and/or within the public right-of-way at any other times is prohibited.
   (d)   It shall be the duty of every operator of a business within the Village to make the necessary arrangements for the pickup and removal of rubbish and garbage so as not to overload the containers or receptacles.
   (e)   Every operator of a business within the Village shall maintain the outside premises free from all trash, wastes and garbage unless deposited into an approved waste container.
   (f)   No operator of a business within the Village shall place, or cause to be placed, any garbage or refuse generated by the business in a public waste receptacle owned or placed by the Village or in a receptacle owned or placed by another business operator.
   (g)   No person shall tamper with, interfere with, carry away, damage, or destroy any garbage or refuse receptacles owned by the Village or another person.
   (h)   The public is encouraged to use public waste disposal receptacles on the public streets and sidewalks in the Village for immediate disposal of small items normally discarded by pedestrians and passing motorists while they are in transit. Nothing in this section prohibits a business operator from placing such receptacles for public use upon a sidewalk and/or public right- of-way, provided that:
      (1)   Such receptacles are regularly emptied at least as often as the business’s regular refuse collection;
      (2)   Such receptacles do not obstruct pedestrian or vehicle traffic; and
      (3)   Such receptacles are not used by the business for the deposit of garbage or refuse generated by the business.
