927.03  MUNICIPAL ELECTRIC RATES; PURCHASED POWER COST ADJUSTMENT.
   (a)   The rate schedule to be charged to consumers for electrical power supplied by the Village of Wellington Municipal Utilities as attached hereto, is hereby established and denominated as the initial "Base Rate Schedule" for electrical service; the attached base rate schedule shall be implemented for electric service billings issued on and after May 1, 2010.
   (b)    Beginning with the electric service billings under the new base rate schedule adopted in paragraph (a), there will be a purchased power cost of adjustment added to (or subtracted from) the existing base rate schedule, which shall be based on a comparison of an anticipated cost of $71 per megawatt hour and the Village's actual cost of acquiring power, prorated based on the consumer's usage.  The Director of Finance shall determine that amount each month and that increased (or reduced) rate shall be in addition to the base rate schedule to be charged with the next months billing.
   (c)    Notwithstanding anything to the contrary as set forth hereinabove, at any time, the Cost of Production/Providing may be adjusted or eliminated if the Council, by majority vote, declares that any Cost increase which would normally be awarded shall either be eliminated or reduced, as Council may designate.
   (d)    At the earlier of either (1) April 1, 2015, or (2) any time when the Village's actual cost of acquiring power over a three-month average exceeds $86 per megawatt hour, the Village Manager shall cause a new electrical rate study to be done, and shall report his findings to Council for their consideration at that time.  Nothing in the foregoing provisions shall be construed to restrain or restrict the authority of any future Council to either alter, amend, or repeal the structure of Cost of Producing/Providing adjustments provided herein, or to implement any further increases or reductions in rates at any time, as Council at that time may deem appropriate, or as may be required under other legislation or covenants by the Village.
   (e)    Notwithstanding and in lieu of the foregoing electrical rates set forth in paragraphs (a) and (b), a separate optional rate schedule to be charged to "Large Power Consumers" (defined as an average monthly consumption through one meter at one location of 600,000 KWH measured over a preceding six month rolling average or in the event of falling below that average a twelve month average would be considered) for electrical power supplied by the Village of Wellington Municipal Utilities as attached hereto, is hereby established; the attached base rate schedule shall be implemented for electric service billings issued on and after May 1, 2010.  The Large Power Consumers rate will be established based upon the Village's three month average wholesale cost of power as purchased by the Village, plus 10%.  For each billing cycle, a consumer which is eligible for this rate shall have the option whether this rate will or will not be applied; and there will be a rebuttable presumption that the consumer elects the rate which will generate the lowest bill to the consumer for the billing cycle.  The Manager shall provide Council annually a report on what consumers are participating in this rate schedule, and each consumer's rates of employment.  (Ord. 2010-20.  Passed 5-17-10; Ord. 2010-45.  Passed 12-20-10; Ord. 2012-13.  Passed 5-7-12.)
