(a) No person, while in any place of public assembly or in any entrance, lobby, foyer, passageway, restroom, office or anteroom, or other room in connection therewith, shall have in his possession, disseminate, distribute or deposit, with intent to cause bodily discomfort, panic or damage to property, any liquid, powder or other substance which is capable of producing an annoying, offensive, nauseating or foul odor, or causing a panic or damage to property.
This section does not apply to regularly appointed police officers acting in the line of duty, nor to proprietors of various business places where such substance is kept solely for the purpose of repelling robbers, thieves, marauders or other law violators.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
