529.05 PERMIT REQUIRED.
   (a)   No person personally or by the person’s clerk, agent or employee shall manufacture, manufacture for sale, offer, keep or possess for sale, furnish or sell, or solicit the purchase or sale of any beer or intoxicating liquor in this Municipality, or transport, import or cause to be transported or imported any beer, intoxicating liquor or alcohol on or into this Municipality for delivery, use or sale, unless the person has fully complied with Ohio R.C. Chapters 4301 and 4303 or is the holder of a permit issued by the Division of Liquor Control and in force at the time.
   (b)   Notwithstanding any other provision of this chapter, persons may lawfully sell, distribute, and/or consume wine (as defined in Ohio Revised Code Section 4301.01) in or upon grounds owned by the Village of Wellington, under the following conditions:
      (1)   An appropriate license/permit has been issued by the State of Ohio; and
      (2)   The wine is being sold, distributed, and/or consumed in a manner which is consistent with that state-issued license/permit;
      (3)   The permit holder has provided to the Village a certificate of insurance demonstrating that current liquor liability insurance, in a minimum amount of $1,000,000, in is place, as to which the Village of Wellington is named as an additional insured.
      (4)   The Council of the Village of Wellington has expressly authorized the function on Village grounds at which the activity is conducted.

   (c)   Whoever violates this section is guilty of a minor misdemeanor.
